Large settlement in gas contract dispute
Ware Jackson partners Knox Nunnally and Michelle Meriam Blair secured an eight-figure settlement for a midstream energy client. The case involved a force majeure dispute related to the impact of Winter Storm Uri (“Uri”) on West Texas natural gas production in 2021. The midstream company had a firm contract for gas to be delivered, but the operator failed to deliver the contractual quantities of gas during Uri. The operator claimed force majeure and an executive order by the Texas Governor precluded them from complying with the contract. Ware Jackson attacked these defenses and ultimately secured a very large and favorable settlement for the client.
